Letter: To Tax or Not to Tax? 'Obamacare' Decision Leaves Many Questions

Some of you have asked for my take on the Supreme's Court decision on Obama Care.  As distasteful as it may be, in my opinion, Chief Justice Roberts got some of it right & much of it wrong.  He said:

1)  The mandate is unconstitutional under the Commerce clause.  The left had wanted it to be constitutional under this clause. The liberals are really ticked off at this portion of his ruling as they wanted much more power than they got under the taxing ruling.  (A long term victory for conservatives in my opinion).

2)  That Article One of the US Constitution, section 8, clause 18:  The Congress shall have Power - To make all Laws which shall be necessary and proper...  does not apply - (A victory for Conservatives)

3)  Article I, Section 8, Clause 1 of the Constitution gives Congress to collect taxes.  This is the part that Roberts said applies.  The government cannot demand people buy something, but if they DON'T, they can be taxed.  This was HIS THEORY.

No one predicted this outcome because the government argued both sides of this issue - they said on one day that it is NOT a tax.  On another day, they said it WAS a tax.   This was a real stretch as far as I'm concerned – he was looking for a way to rule the way he did.

My thoughts:

Roberts became an activist judge as BOTH sides of the same issue were argued by the Government!  So, John Roberts permitted this – both an error and fraud in my opinion.  Roberts rewrote the government's arguments!  He rewrote the Constitution.  The other four conservative judges said the whole thing was unconstitutional as presented.  I think they were right.

Roberts indicated that it was NOT the court's duty to determine the properness of this legislation but that it is THE PEOPLE'S DUTY to vote in those who do what people want.  He had this part right.  Hmmm... So, sleeping giant (that's us, folks!), vote into office reps who will keep taxes low and do other things that we want.

Yes, let's vote those who will NOT tax us to death... those who will do what is right for America – our Republic is in our hands like never before.  If I remember correctly, the  conservatives have been handed a small victory here because, if a TAX issue is in force, a super majority of 60 percent of the Congress is required to overturn it. 

But, if it is not yet in force and a lawsuit is instituted BEFORE it is in place (doesn't hit until 2014), then only 51 percent (a simple majority) is required to overturn it.  If we DON'T win this time around, they will tax us for NOT buying a hybrid, for NOT installing solar panels on our roof, for NOT buying health insurance, for NOT eating the right food and on and on.

There will be no end to this taxing.  We will lose more freedom then can be imagined.  Obama is a manipulator beyond belief – he said it was NOT a tax and sold it as such.  The Supreme Court said it is a tax.  A blessing in disguise?  We have an opportunity if we take advantage of it.  For America to survive as our generation has known it, we must act like never before.
